Statutory Definition of Illegal AbortionIntentional interruption of a pregnancy by the application of external agents, whether chemical or physical, or the ingestion of chemical agents with an intention other than to produce a live birth or to remove a dead fetus
Statutory Definition of Legal AbortionBefore viability by physician; after viability, only when necessary to preserve life or health of mother
Penalty for Unlawful AbortionClass D Crime: M.D. failing to perform any action required: fine up to $1000 for each violation, not taking reasonable steps to preserve life of live born child: subject to homicide, manslaughter and/or malpractice liability
Consent RequirementsInformed written consent by minor and consent of one parent/guardian required for persons under 18 yrs. old except in emergencies or if judicial consent is obtained; informed written consent of all women required
